1. Company details and scope of these terms
These general terms govern purchases made at modelkitmania.com and the relationship between Model Kit Mania S.L. and its customers, together with the information and specific terms provided before entering into the contract.

A user is a person who uses this website, and a customer is a person who purchases the products or services offered. You may purchase as a guest or through a customer account, which is optional. Users and customers are responsible for the accuracy of the information they provide.
To enter into a contract, you must have the necessary legal capacity or be duly represented. By confirming your purchase, you declare that you have read and accepted the terms provided before entering into the contract.
2. Availability, validity and changes to the terms
These terms will be available before you start the purchase process and may be saved or printed.
Each purchase will be governed by the terms and information provided before the order is confirmed. Subsequent updates will apply to future purchases and will not change orders already contracted.
If a clause is invalid or unenforceable, this will not affect the remaining terms where the contract can continue without that clause and consumers' statutory rights are respected.
3. Subject of the contract, products and services
The sales contract governs the delivery of one or more products in exchange for the price stated during the purchase. Any product-specific terms will be provided before entering into the contract, in the product listing or applicable policies, according to the product's characteristics and nature.
The store offers Gunpla, model kits, tools, paints, accessories and modelling components, as shown in the published catalogue. Each product listing describes the product's characteristics and contents. If an image includes illustrative items that are not supplied, this will be expressly stated.
Personalised services will have their own pages and specific terms, which will be provided before entering into a contract. Their inclusion in this section does not mean that they are already available to order.
4. Optional customer account
A customer account is optional. You can purchase at modelkitmania.com as a guest, without registering or being required to sign in. During checkout, you must provide the contact, billing and delivery details necessary to manage your order.
If you wish to use your account, you can access it through the user icon in the store. You sign in using your email address and a single-use verification code sent to that address; you do not need to create a password.
Your account allows you to view your orders and manage your profile details and saved addresses. Purchasing and exercising your rights do not depend on using an account.
You must provide accurate information and protect access to your email account. Do not share verification codes. If you detect unauthorised access, notify web@modelkitmania.com.
Using an account does not, by itself, subscribe you to newsletters or marketing communications.
5. Geographical scope and language
We ship to Spain and the other European Union countries. Delivery availability for your specific address, delivery options and shipping charges are displayed before you complete your purchase. We do not currently ship outside the European Union, including to the United Kingdom.
The purchase process and pre-contractual information are provided in Spanish, which is the language of the contract. An English translation of these terms is also available for ease of reference, without limiting consumers' statutory rights.
6. Prices, taxes and charges
Prices are displayed in euros and include applicable taxes where relevant. The total order amount, taxes and shipping charges will be stated before you confirm your purchase. No optional paid services will be added without your acceptance.
We may update product prices and offers for future purchases, without changing the price of orders already contracted.
7. Purchase process and availability
Add products to your basket and follow the on-screen instructions. You can continue as a guest or optionally sign in using your email address and the verification code sent to that address.
Before confirming your purchase, you can review the products, quantities, address, delivery method and total price, and correct the information entered. By confirming your order, you accept the terms of purchase and any specific terms provided before purchasing.
Availability and purchase conditions are stated in each product listing. Products will only be purchased as pre-orders or reservations where they are expressly identified as such.
If a product already contracted cannot be supplied, we will inform you and refund the relevant amounts paid without undue delay. We will not substitute another product without your acceptance. Outstanding payments will be handled in accordance with the terms provided and applicable law.
There is no maximum order amount.
How to cancel an order
Contact web@modelkitmania.com as soon as possible. If the order can still be stopped, we will arrange the appropriate cancellation. Where a right of withdrawal applies, you can also notify us before receiving the order, even if it has already been dispatched. Returns and refunds, including the original standard delivery charges, will be governed by the Returns and Refunds Policy.
8. Shipping, collection and receipt
Available delivery methods and charges are displayed before you confirm your purchase, according to the destination and order characteristics. Free shipping from €99 applies exclusively to mainland Spain, subject to the Shipping Policy; the Balearic Islands and all other destinations are excluded.
Orders are shipped to the address provided during checkout. Where collection is available at checkout, you can collect your order free of charge from our collection point at Calle Mar del Japón, 13, 28033 Madrid, Spain. You must wait for notification that your order is ready and arrange an appointment by emailing web@modelkitmania.com or through WhatsApp at +34 689 399 841, quoting your order number in either case. Please attend only on the agreed date and time.
Preparation and delivery times
For products available in stock, the usual order preparation time is 1 to 2 working days from payment confirmation, unless the product listing states a different period. Orders placed on weekends or public holidays will begin processing on the next working day.
Once the order has been handed to the carrier, transit time depends on the destination and selected service. Stated times are estimates unless a guaranteed delivery date is expressly agreed.
Delivery will take place without undue delay and, unless a different period was agreed before purchase — for example, for a pre-order — within 30 calendar days of entering into the contract.
If you notice damage when receiving your parcel, we recommend recording it and retaining photographs and packaging where possible. Failure to do so does not automatically remove your rights. Notify web@modelkitmania.com so that we can handle the issue.
9. Invoices
Order invoices are issued exclusively through Finseed. All our orders include a paper copy of the invoice inside the parcel at no additional cost. The invoice will be associated with the corresponding order; the order number identifies the purchase and does not replace the invoice number.
If you also wish to receive an invoice copy by email, you can request it by writing to contabilidad@modelkitmania.com and quoting your order number. Electronic copies are sent only at the customer's request; they are not sent automatically.
The Shopify customer account allows you to view orders and their numbers, but does not issue a second invoice. Order confirmations and invoices are separate documents; invoices are issued through Finseed and provided as described in this section.
10. Payment and order confirmation
You can pay by bank card and any other payment methods available during checkout. The options applicable to your order will be displayed before you confirm payment.
If payment is not authorised, the corresponding notice will be displayed. You can check your details or try again using another available payment method. The order will not be considered paid until payment is confirmed.
Payments are processed through Shopify Payments or the other providers enabled during checkout, using encrypted connections. The card details required to process payment are handled by Shopify and/or the relevant payment provider in accordance with their security measures and privacy policies.
Use of each payment method is subject to the relevant provider's applicable terms, without prejudice to consumers' statutory rights.
You will receive order confirmation by email, including your order number and the essential purchase information. You may receive further communications about payment and preparation or delivery. Your invoice will be provided as described in the “Invoices” section.
The confirmation email provides a record of the purchase and is not an invoice. The order invoice is issued exclusively through Finseed and provided as described in the “Invoices” section. Your statutory guarantee rights do not depend on having a customer account.
You can view order information and order numbers through your customer account, if you choose to use it, or retain your confirmation emails. To request an invoice copy by email, write to contabilidad@modelkitmania.com, quoting your order number.
Fraud prevention checks
Where there are objective indications of fraud, we may carry out necessary checks and take proportionate measures in accordance with applicable law. Issues affecting an order will be communicated to the customer where legally appropriate, with delivery, cancellation or refunds handled as applicable.
11. Returns, withdrawal and defective products
Consumers making online purchases generally have 14 calendar days from receipt to notify us of withdrawal without giving a reason. No prior authorisation is required, and withdrawal may be notified before receiving the order. After notification, goods must be sent back without undue delay and no later than the following 14 calendar days.
Opening a model kit's box or ordinary seal does not automatically remove the right of withdrawal. Cutting parts, assembling, gluing, sanding, painting or modifying the kit may result in an actual, justified reduction in value if it goes beyond the handling necessary to inspect it. We will assess its specific condition and communicate the valuation to the consumer; withdrawal will not automatically be rejected because a part has been cut.
When exercising the right of withdrawal, the customer bears the direct return costs disclosed in advance. We will refund the amounts required by law, including the original standard delivery charges, using the same payment method unless otherwise expressly agreed at no cost to the consumer. The supplement for a more expensive delivery method chosen by the customer is not refunded.
The refund will be processed without undue delay and no later than 14 calendar days from notification of withdrawal. Unless we offer to collect the goods, we may withhold the refund until we receive them or receive evidence that they have been sent back, whichever occurs first.
Goods made to the customer's specifications or clearly personalised may be excluded from the right of withdrawal only where the legal exception applies and the customer was informed before purchase. 3D printing a standard product does not, by itself, make it personalised. Rights relating to defects or lack of conformity remain unaffected.
If the product is incorrect, a part is missing, or there is a defect or damage attributable to the store or transport arranged by us, we will provide the appropriate legal remedy without passing its costs on to the consumer. We may request photographs or other suitable evidence; a specific photograph or intact packaging is not an absolute condition for exercising statutory rights.

The full procedure, form, calculation of deadlines and exceptions are set out in the Returns and Refunds Policy, which forms part of these terms.
12. Statutory guarantee for products
Model Kit Mania S.L., as the seller, is responsible for a lack of conformity in new goods sold to consumers in Spain that becomes apparent within 3 years of delivery, in accordance with applicable law. A manufacturer's commercial warranty does not replace or limit this statutory guarantee.
Subject to the legal requirements in each case, the consumer may be entitled to repair, replacement, a price reduction or termination of the contract. Bringing the goods into conformity will be free of charge, including necessary shipping, transport, labour and material costs. Damage caused by incorrect handling by the customer is not an original defect, but this does not permit an actual lack of conformity to be excluded.

13. Website operation and the store's rights
We may update the website or temporarily interrupt its operation for maintenance or security. This does not alter our obligations concerning orders already contracted or prevent consumers from exercising their rights through the published contact channels.
We may proportionately restrict access in response to fraudulent or unlawful use, or use that compromises the store's security. Such restrictions do not remove rights relating to orders already placed or access to customer service, invoices, returns or guarantees.
We may correct errors on the website. If an error affects an order already contracted, we will communicate the issue and handle it in accordance with applicable law. This clause does not permit us to unilaterally change what was agreed or automatically cancel any order.
The store is entitled to receive payment for accepted purchases and to retain ownership of an item until it is paid in full, in accordance with applicable law.
14. Intellectual property and liability
Protected website content belongs to Model Kit Mania S.L. or its respective rights holders. Its exploitation requires permission where legally applicable. This does not prevent you from saving or printing these terms and your purchase documentation, or making uses permitted by law.
You must provide accurate details and report any errors you detect. The consequences of incorrect details or misuse will be assessed according to their cause and applicable law.
Model Kit Mania S.L. will remain liable where required by law. Technical incidents, security failures or third-party interruptions do not automatically exclude that liability or our obligations regarding orders already contracted.

As an additional channel required by law, you may also send enquiries and complaints by post to Model Kit Mania S.L., Calle Mar del Japón, 13, 28033 Madrid, Spain. The registered office, which differs from the correspondence address, is stated in the company details section.
We will provide a reference and written acknowledgement of your complaint. We will respond as soon as possible and no later than fifteen days after it is submitted. Legally available alternative dispute resolution channels, public consumer bodies and competent courts remain available. Where applicable, we will provide information about the competent alternative dispute resolution body and our participation in accordance with applicable law.
Finally, you can use WhatsApp at +34 689 399 841 exclusively for orders already placed, always quoting your order number. For general enquiries, please preferably use the website chat or email.
16. Applicable law and jurisdiction
These terms are governed by Spanish law. If you purchase as a consumer and reside in another country, this choice does not deprive you of the protection afforded by mandatory rules applicable in your country of habitual residence. Disputes will be submitted to the courts competent under applicable law, without requiring consumers to waive their legally applicable jurisdiction.
